For the purposes of these Terms and Conditions:

"Service" refers to PinImage Studio, including the web application, API, templates, and all related features accessible at pinimagestudio.com.

"Company," "We," "Us," or "Our" refers to PinImage Studio and its operators.

"User," "You," or "Your" refers to any individual or entity accessing or using the Service.

"Account" refers to the unique account created for you to access the Service.

"Content" refers to any text, images, designs, or other materials created, uploaded, or generated through the Service.

"Pin" refers to a Pinterest-optimized image created using the Service.

"API" refers to the Application Programming Interface provided by PinImage Studio for programmatic access to the Service.

"API Key" refers to the unique authentication credential (prefixed with pk_live_) issued to eligible subscribers for API access.

"Subscription" refers to a paid plan granting access to Service features.

"Free Plan" refers to the no-cost tier of the Service with limited features.

"Pro Plan" refers to the $19/month subscription tier.

"Agency Plan" refers to the $49/month subscription tier.

"Quota" refers to the monthly limit of pins a user may generate based on their subscription plan.

"Template" refers to pre-designed pin layouts available within the Service.

"Third-Party Services" refers to external platforms and services integrated with or referenced by PinImage Studio.

2.1 Agreement to Terms

By creating an account, accessing, browsing, or using PinImage Studio in any way, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions, our Privacy Policy, and any additional guidelines, policies, or rules applicable to specific features of the Service.

2.2 Legal Capacity

By using the Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into binding agreements
• You are not prohibited from using the Service under applicable law

To use PinImage Studio you must create an account and provide accurate information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must be at least 13 years of age to register. We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

Paid plans (Pro and Agency) are billed monthly through our payment processor, Lemon Squeezy. By subscribing you authorise recurring charges at the then-current plan price. All prices are in USD. Taxes may apply depending on your location and are calculated at checkout. Your subscription renews automatically at the end of each billing period unless cancelled beforehand. You may cancel at any time from your Lemon Squeezy billing portal; access continues until the end of the current paid period, after which your account reverts to the Free plan.

PinImage Studio offers three plans:

• Free — 5 pins per month, 6 starter templates, no API access.
• Pro — 500 pins per month, all 15 templates, API access, Google Drive sync.
• Agency — 1,500 pins per month, all 15 templates, full API access, Google Drive sync, multiple brand profiles.

Pin credits reset on the 1st of each calendar month and do not roll over. If you reach your monthly limit, pin generation pauses until the next reset or until you upgrade. Upgrading takes effect immediately and credits reset at the start of the next billing cycle. Downgrading takes effect at the end of the current billing period.

API access is available on Pro and Agency plans only. You may generate, regenerate, and revoke API keys from your dashboard. Each key starts with pk_live_. Keys are shown only once at creation — store them securely. You are responsible for all requests made with your keys. Do not share keys publicly or embed them in client-side code. Rate limits apply: 60 requests per minute per key. Monthly pin quotas are shared between the dashboard and the API — every pin generated via the API deducts from your plan's monthly credit. We reserve the right to suspend keys that are used abusively or in violation of these Terms.

You retain full ownership of all content you submit to PinImage Studio (titles, images, brand assets). By submitting content you grant us a limited, non-exclusive, royalty-free licence to process and store it solely to provide the service. You own full rights to every pin you generate and may use them commercially — on Pinterest, your blog, in advertisements, or elsewhere. You represent that you have the right to use any images you submit and that doing so does not infringe any third party's rights.

You agree not to use PinImage Studio to:

• Generate content that is unlawful, defamatory, obscene, or infringes any intellectual property rights
• Submit images you do not have the right to use
• Attempt to reverse-engineer, scrape, or abuse the API beyond documented rate and quota limits
• Use automated means to create accounts or circumvent plan restrictions
• Resell or sublicense API access to third parties without our written permission
• Interfere with or disrupt the service or its infrastructure

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

PinImage Studio, its templates, software, and branding are owned by us and protected by applicable intellectual property laws. You may not copy, modify, or distribute our software or templates outside of normal product use. The pins you generate are yours — our templates are the tools, not the output.

PinImage Studio integrates with third-party services including Supabase (database and storage), Lemon Squeezy (payments), Google Drive (optional sync), Pexels and Openverse (stock imagery), and Cloudflare (infrastructure). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

PinImage Studio is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted availability. We do not guarantee that the service will be error-free or that generated pins will meet any specific performance criteria on Pinterest.

To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or relating to these Terms or the service shall not exceed the amount you paid us in the three months preceding the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

You agree to indemnify and hold harmless PinImage Studio and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the service, your content, or your violation of these Terms.

We may modify these Terms at any time. We will notify you of material changes by email or by posting a notice on the site. Continued use of the service after changes take effect constitutes acceptance of the revised Terms. We may also modify, suspend, or discontinue any part of the service at any time with reasonable notice where practicable.

If your account is terminated:

• Access to the Service will be revoked immediately
• No refunds will be issued for unused subscription periods
• You will have 30 days to download all your content before deletion

16.1 Good Faith Resolution

Before pursuing formal dispute resolution, both parties agree to attempt resolution through good faith negotiation for at least 30 days.

16.3 Governing Law

These Terms shall be governed by applicable laws without regard to conflict of law principles.

16.4 Informal Resolution

We are committed to resolving disputes quickly and fairly. Most issues can be resolved by contacting our support team at hello@pinimagestudio.com.

17.1 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

17.2 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

17.3 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

17.4 Force Majeure

We shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including natural disasters, government actions, internet disruptions, or third-party service failures.

17.5 Headings

Section headings are for convenience only and do not affect the interpretation of these Terms.

17.6 Language

These Terms are written in English. Any translations are provided for convenience only. In case of conflict, the English version prevails.
